prepares case specific Juror Questionnaires.
The Juror Questionnaires are completed by potential jurors before the
Voir Dire process. Therefore,
counsel has the advantage of knowing how to streamline Voir Dire questions for
each prospective juror to elicit the most critical responses.
Research
demonstrates that individuals are more honest when writing responses rather than
verbalizing opinions. The fact that
potential jurors are asked to sign the questionnaires also improves the
likelihood that the information provided in writing is more reliable than the
information provided during a standard verbal Voir Dire process.
Juror Questionnaires
are best used in cases involving delicate subject matter
and/or cases that will take a significant period of time to try.
When questionnaires are used in these scenarios, counsel has the ability
to weed out jurors in advance, without spending unnecessary time questioning
jurors during Voir Dire. Additionally,
those jurors who present some personal experiences or hold personal opinions on
delicate subject matters can be given the opportunity, outside of the presence
of other jurors, to express their opinions.
Otherwise, jurors may withhold critical information when asked questions
in an open courtroom setting.
In Federal Court, Juror Questionnaires are extremely important because counsel is only permitted a very limited amount of time to question potential jurors, if any at all. The weight given to the questionnaires thus becomes important in determining the best jurors for a given case.
