
A
Shadow Jury is a group of qualified jurors from the respective venue who
actually monitor and evaluate a case just like the empaneled jurors.
These “shadow jurors” are present during the entire trial.
They receive all of the evidence and exit the courtroom whenever the
sitting jurors are excused or dismissed. They
are not privy to any information other than that presented during trial.
The
comments and observations of the concurrent jurors, or shadow jury, are gathered
by JDL’s jury consultant and reported to counsel.
What
are some of the reasons to use a Shadow Jury?

provide counsel with questions that have not been addressed,

educate counsel on areas of concern regarding liability and/or damage issues.
Shadow
Jurors are not informed which party has requested that they be present.
JDL’s Trial Consultant is the only person who communicates with the
“Shadow Jury.” The jurors are
questioned individually and as a group. JDL’s
Trial Consultant then reports the day-to-day findings to counsel and makes
appropriate recommendations to counsel in an effort to improve the client’s
position during trial.
JDL utilizes psychological measures when interviewing potential jurors and forming a “Shadow Jury.” The case specifics are important variables, as well as the designated venue and the potential for a high dollar verdict.
The Shadow Jury serves as a daily progress report and allows counsel to GAIN THE ADVANTAGE of an opportunity to improve his/her client’s position before closing statements and jury deliberations.
